Niniejszy Regulamin zwany dalej “Regulaminem” określa zasady dostępu do szkoleń w ramach e-learningu, zasady, warunki oraz sposób świadczenia usług za pośrednictwem Platformy szkoleniowej znajdują się na stronie www.academy47.com pod linkiem learn.academy47.com

§ 1.
DEFINICJE

Ilekroć w Regulaminie mowa jest o:
Academy47 – należy przez to rozumieć spółkę Academy47 Spółka z ograniczoną odpowiedzialnością z siedzibą w Warszawie pod adresem: ul. Krucza 50, 00-025 Warszawa, wpisana do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy dla m.st. Warszawy w Warszawie, XII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000927172 z kapitałem zakładowym w wysokości 50.000,00 PLN posiadająca NIP: 5252880776, REGON: 520213578;

Zamawiający – podmiot, w tym osoba fizyczna posiadająca pełną zdolność do czynności prawnych, która zawiera umowę z Academy47 ;

Uczestnik Szkolenia – osoba mająca dostęp do Materiałów Szkoleniowych w ramach świadczenia Usługi Szkoleniowej lub/i korzystająca z z dostępu do Usługi Mentoringu to jest Zamawiający lub inna osoba wskazana przez Zamawiającego;

Konsument – osoba fizyczna będąca konsumentem zgodnie z art. 221 Kodeksu cywilnego korzystająca z Platformy Szkoleniowej oznacza to osobę fizyczną dokonującą z przedsiębiorcą czynności prawnej niezwiązanej bezpośrednio z jej działalnością gospodarczą lub zawodową lub osoba fizyczna zawierająca umowę bezpośrednio związaną z jej działalnością gospodarczą, gdy z treści tej umowy wynika, że nie posiada ona dla niej charakteru zawodowego, wynikającego w szczególności z przedmiotu wykonywanej przez nią działalności gospodarczej, udostępnionego na podstawie przepisów o Centralnej Ewidencji i Informacji o Działalności Gospodarczej;

Materiały szkoleniowe – wszelkie treści szkoleniowe publikowane i udostępniane na Platformie szkoleniowej, w jakiejkolwiek formie w tym jako programy edukacyjne, kursy, moduły, w szczególności treści cyfrowe, audiowizualne, tekstowe, graficzne, fotograficzne oraz dźwiękowe, będące przejawem działalności twórczej o indywidualnym charakterze utrwalone w jakiejkolwiek formie, niezależnie od ich przeznaczenia i niezależnie czy stanowią utwory w rozumieniu ustawy z dnia 4 lutego 1994 r. o prawie autorskim i prawach pokrewnych, a w szczególności nagrania video kursów, pojedyńczych szkoleń i programów edukacyjnych on-line w szczególności tematyce marketingowej,sprzedażowej i z zakresu HR ;

Platforma Szkoleniowa – internetowa platforma e-learningowa dostępna pod adresem na stronie www.academy47.com pod linkiem learn.academy47.com, lub jego rozwinięciami umożliwiajaca w wyniku zawartej Umowy dostęp do wybranych Materiałów Szkoleniowych na zasadach określonych Umową. Głównym zadaniem platformy jest przekazanie wiedzy o tematyce marketingowej, sprzedażowej i z zakresu HR. Dostęp do niej jest chroniony hasłem i wymaga zalogowania się przy użyciu identyfikatora zwanego loginem.

Umowa – umowa zawierana na odległość drogą elektroniczną ( bez fizycznej obecności stron) za pośrednictwem strony www.academy47.com z Academy47 a Zamawiającym , której przedmiotem jest świadczenie przez Academy47 Usług oferowanych na Platformie Szkoleniowej, treść Umowy stanowią postanowienia Regulaminu;

Usługa Szkoleniowa – odpłatna usługa, polegająca na dostępie do treści cyfrowych, audiowizualnych, plików video w postaci wybranych Materiałów Szkoleniowych umożliwiająca korzystania z nich za pośrednictwem Platformy Szkoleniowej zarejestrowanemu i zalogowanemu Uczestnikowi Szkolenia w miejscu i czasie wybranym przez niego;

Usługa Mentoringu – odpłatna usługa polegająca na dostępie do indywidualnego lub grupowego udziału w zajęciach on-line z osobą wskazaną przez Academy47 w celu zadawania pytań, indywidualnego coachingu czy wykorzystania nabytej wiedzy podczas korzystania z Usługi Szkoleniowej, dostępna na Platformie Szkoleniowej;

Dane Uczestnika Szkolenia – dane przy użyciu których Academy47 może kontaktować się z Uczestnikiem Szkolenia w celu wykonania Usługi obejmujące imię i nazwisko, nazwa podmiotu, adres poczty elektronicznej, dane do płatności, adres, numer telefonu, dane podane w ankiecie/kwestionariuszu.

Konto – konto, które zakłada Zamawiający w celu zawarcia Umowy i dostępu do Platformy Szkoleniowej.

Platforma sprzętowa – środowisko programistyczne spełniające określone w Regulaminie minimalne parametry techniczne i posiadające dostęp do Internetu, pozwalające na korzystanie z Platformy Szkoleniowej ;

Cennik – aktualny cennik zakupu dostępu do poszczególnych Modułów umieszczony na stronie www.academy47.com lub jej rozwinięciach.

§ 2
POSTANOWIENIA OGÓLNE

Academy47 świadczy Usługi Szkoleniowe oraz Usługi Mentoringu, zwane w dalszej części Regulaminu łącznie “Usługami” lub osobno zwane Usługą , o ile postanowienia Regulaminu obowiązują w stosunku do każdej z tej Usługi , zgodnie z Regulaminem i przepisami prawa.
Usługa Szkoleniowa świadczona przez Academy47 jest dostępna 7 dni w tygodniu 24 godziny na dobę.
Academy47 zastrzega sobie prawo do zmiany Usług szczególności treści Materiałów Szkoleniowych oferowanych Zamawiającemu na Platformie Szkoleniowej oraz zasad świadczenia Usług, o czym poinformuje Zamawiającego w sposób właściwy dla zmiany Regulaminu.
Zamawiający może w dowolnie wybranym przez siebie czasie uzyskać dostęp i pobrać Regulamin, utrwalić go, otworzyć, wydrukować lub zapisać go.
Wszelkie informacje, Materiały Szkoleniowe udostępniane Zamawiającemu znajdujące się na stronie www.academy47.com w tym na Platformie Szkoleniowej, a w szczególności: znaki towarowe, nazwy handlowe, hasła reklamowe, loga, grafika, obrazy, rysunki, fotografie, zdjęcia, materiały cyfrowe, nagrania audiowizualne i nazwy domen, które pojawiają się na Platformie Szkoleniowej należą lub przysługują Academy47 albo osobom trzecim oraz podlegają ochronie prawnej.
Zawartość Platformy Szkoleniowej, w szczególności Materiały Szkoleniowe, podlegają ochronie prawnej.
Wszystko co umieszczone jest na Platformie Szkoleniowej, w tym w szczególności jej nazwa handlowa, hasła reklamowe, logo, grafika, lub obrazy, nie może być kopiowana lub powielana w jakikolwiek sposób, bez uprzedniej pisemnej zgody Academy47 Wykorzystywanie ich jest zabronione i narusza bezwzględnie obowiązujące przepisy prawa.
Zamawiający ponosi odpowiedzialność za naruszenie praw Academy47, a w szczególności prawa autorskiego i praw pokrewnych, prawa do znaku towarowego, dóbr osobistych i majątkowych Academy47 i osób trzecich w tym ponosi odpowiedzialność za innych niż Zamawiający Uczestników Szkolenia;

§ 3
WARUNKI KORZYSTANIA Z USŁUG NA PLATFORMIE SZKOLENIOWEJ

Ponieważ Regulamin określa zasady zawierania Umowy oraz świadczenia Usług Regulamin jest dostępny na stronie https://academy47.com/terms-of-service
Regulamin stanowi regulamin, o którym mowa w art. 8 ustawy z dnia 18 lipca 2002 r. o świadczeniu usług drogą elektroniczną.
Uczestnikiem Szkolenia może być Zamawiający lub inna osoba wskazana przez Zamawiającego, która pragnie zdobyć lub uzupełnić posiadaną wiedzę w zakresie sprzedaży, marketingu lub HR w ramach dostępu do Platformy Szkoleniowej na stronie www.academy47.com.
Academy47 zastrzega sobie prawo do procesu weryfikacyjnego Uczestników Szkolenia przed udzieleniem dostępu do Usług poprzez wypełnienie ankiety udostępnianej Zamawiającego przed zakupem Usługi.
Przed zakupem Usługi Zamawiający powinien zapoznać się z Regulaminem. Zamawiający rejestrując Konto na Platformie Szkoleniowej potwierdza, że zapoznał się Regulaminem oraz akceptuje zawarte w nim postanowienia w całości i bez zastrzeżeń. Oświadczenie to jest składane poprzez odznaczenie odpowiedniego okienka (check boxa) w toku rejestracji.
Academy47 stosuje mechanizm plików “cookies”, które podczas korzystania przez Uczestników Szkolenia z Platformy Szkoleniowej i strony www.academy47.com , zapisywane są przez serwer na urządzeniu końcowym. Stosowanie plików “cookies” ma na celu poprawne działanie Platformy Szkoleniowej na urządzeniach końcowych Uczestników Szkolenia. W celu zapoznania się ze szczegółowymi informacjami dotyczącymi stosowania plików cookies przeczytaj politykę cookies znajdującą się na stronie https://www.academy47/.
Zamawiający zobowiązany jest chronić swoje hasło do Konta przed osobami nieuprawnionymi i nie wolno mu udostępniać hasła osobom trzecim z wyłączeniem Uczestników Szkolenia . Academy47 nie zwraca się do Zamawiającego czy Uczestnika Szkolenia z prośbą o udostępnienie mu hasła. Jednocześnie Academy47 stosuje zabezpieczenia dla ochrony danych, znajdujących się na Koncie Zamawiającego, przed nieuprawnionym dostępem i użyciem.
Zamawiający i Uczestnik Szkolenia jest uprawniony do korzystania z zasobów Platformy Szkoleniowej wyłącznie na własny użytek. Bez uprzedniej, wyraźnej zgody Academy 47 nie jest dopuszczalne wykorzystywanie zasobów i funkcji Platformy Szkoleniowej w celu prowadzenia przez Zamawiającego działalności gospodarczej czy w celach komercyjnych, która naruszałaby jakikolwiek interes Academy47 w szczególności do rozpowszechniania, czy wprowadzania do obrotu Materiałów Szkoleniowych oferowanych przez Academy47, ich publikacji, dystrybucji, powielania czy jakiegokolwiek komercyjnego wykorzystywania, ani w całości ani we fragmentach, w jakiejkolwiek formie i zakresie.
W celu utworzenia Konta na Platformie Szkoleniowej konieczne jest posiadanie przez Zamawiającego aktywnego i poprawnie skonfigurowanego konta poczty elektronicznej oraz dokonanie Rejestracji.
W celu Rejestracji, Zamawiający powinien wypełnić formularz rejestracyjny udostępniony przez Academy47 na Platformie Szkoleniowej i udostępnić wypełniony formularz rejestracyjny drogą elektroniczną do Academy47. Podczas Rejestracji Zamawiający ustala swój własny login i hasło.
Po przesłaniu wypełnionego formularza rejestracyjnego, Zamawiający otrzymuje niezwłocznie, drogą elektroniczną na adres e-mail podany w formularzu rejestracyjnym maila z linkiem, który należy aktywować w celu potwierdzenia Rejestracji lub maila z hasłem tymczasowym do Konta. Z chwilą aktywowania w/w linka lub z chwilą pierwszego logowania (w zależności od tego co nastąpi pierwsze), Zamawiający uzyskuje możliwość dostępu do Konta (w tym do zarządzania swoimi danymi). W celu korzystania z Konta wymagane jest zalogowanie przy użyciu hasła. Warunkiem rejestracji na Platformie Szkoleniowej jest wskazanie przez Zamawiającego wszystkich wymaganych danych.
. Academy47 zakazuje dostarczania przez Uczestników Szkolenia treści zabronionych przez przepisy prawa, w tym w szczególności treści obraźliwych lub wulgarnych, nawołujących do przemocy, nienawiści rasowej lub innych treści niezgodnych z dobrymi obyczajami, albo które naruszają dobra osobiste i inne prawa osób trzecich.
Każde działanie Uczestnika Szkolenia powinno być zgodne z prawem, Regulaminem, dobrymi obyczajami, z poszanowaniem dóbr osobistych osób trzecich w tym zwłaszcza innych Uczestników Szkolenia oraz powinno być zgodne z zasadami współżycia społecznego.

§ 4
USŁUGI ŚWIADCZONE PRZEZ ACADEMY47 , ZAWARCIE UMOWY I PŁATNOŚCI

Academy47 świadczy drogą elektroniczną na rzecz Zamawiającego, który dokonał Rejestracji następujące nieodpłatne usługi:
1. prowadzenie Konta,
2. dostarczenie informacji w formie Newslettera dostępnego po wykupieniu Usługi.
Usługa prowadzenia Konta dostępna jest po dokonaniu Rejestracji, na zasadach opisanych w § 3 Regulaminu.
Usługa prowadzenia Konta świadczona jest przez czas nieoznaczony, od momentu rejestracji Konta. Zamawiający, który dokonał rejestracji może samodzielnie, w każdym czasie i bez podania przyczyny usunąć swoje Konto albo zgłosić Academy47 żądanie jego usunięcia.
Usługa prowadzenia Konta jest bezpłatna, jednakże uzyskanie dostępu do pełnego zakresu funkcjonalności Platformy Szkoleniowej, w tym do Materiałów Szkoleniowych wymaga opłacenia Usługi.
Academy47 jest uprawniona do usunięcia Konta lub zablokowania Zamawiającemu dostępu do Usług , w przypadku działania na szkodę Academy47 lub innych Uczestników Szkolenia, naruszenia przepisów prawa, w tym Regulaminu, w szczególności w przypadku, gdy Zamawiający podczas Rejestracji na Platformie Szkoleniowej lub dokonując płatności za Usługi podał dane niezgodne z prawdą, niedokładne lub naruszające prawa osób trzecich, gdy korzysta z Platformy Szkoleniowej w sposób niezgodny z obowiązującym prawem.
Usługa Newslettera polega na przesyłaniu przez Academy47 na adres poczty elektronicznej Zamawiającego wiadomości zawierających informacje handlowe i oferty dotyczące usług świadczonych przez Academy47 i jej partnerów. Zamówienie usługi Newslettera następuje poprzez użycie przez Zamawiajacego właściwego pola aktywacji Newslettera w formularzu rejestracyjnym lub w innym formularzu udostępnionym przez Academy47.
Rezygnacja z usługi Newslettera możliwa jest w każdym czasie, bez podania przyczyny – można samodzielnie zrezygnować z otrzymywania Newslettera poprzez zaznaczenie odpowiedniej opcji rezygnacji z usługi Newslettera używając linka umieszczanego w każdej wiadomości Newslettera.
W ramach dostępu do Platformy Szkoleniowej Zamawiający może dokonać wyboru i zakupu Usług dostępnych na Platformie Szkoleniowej.
Zamówienie Usługi stanowi Umowę zawartą na czas określony na okres wskazany przy wyborze wskazanej Usługi . W celu złożenia zamówienia Zamawiający musi jeżeli wcześniej tego nie czynił – dokonać rejestracji Uczestnika Szkolenia wybrać Usługę i złożyć zamówienie,
Program poszczególnych Usług Szkoleniowych określający zakres tematyczny Materiałów Szkoleniowych dostępny jest na Platformie Szkoleniowej .
Dostęp do Materiałów Szkoleniowych w ramach zakupionego dostępu do Usług Szkoleniowych zamieszczonych na Platformie Szkoleniowej jest możliwy przez cały okres obowiązywania Umowy.
Udostępnienie Usługi Szkoleniowej nastąpi niezwłocznie po otrzymaniu przez Academy47 potwierdzenia akceptacji płatności przez operatora płatności, przy czym Academy47 nie odpowiada za skutki opóźnień w dokonaniu płatności, za które odpowiedzialność ponoszą podmioty obsługujące płatności.
Do zawarcia Umowy pomiędzy Academy47 a Zamawiającym dochodzi po rejestracji Zamawiającego na stronie www.academy47.com , wyboru Usługi i opłaceniu dostępu do Usługi.
Przez realizację Usługi Szkoleniowej rozumie się włączenie dostępu do wykupionych Materiałów Szkoleniowych dla określonego Konta. Uczestnik Szkolenia po zalogowaniu się na swoje Konto ma dostęp do wykupionych Szkoleń poprzez zakładkę „Moje szkolenia”.
Wykupiona Usługa Szkoleniowa będzie aktywna przez okres wskazany w opisie Usługi Szkoleniowej od dnia przekazania Zamawiającemu informacji o zaksięgowaniu całości należnej wpłaty, co umożliwi Zamawiającemu korzystanie w tym czasie z Platformy Szkoleniowej.
W przypadku dokonania przez Zamawiającego zakupu Usługi Mentoringu z oznaczeniem dnia i godzin, w których ma się ono odbyć, Zamawiającemu zostanie włączony dostęp do wykupionego Mentoringu co najmniej 30 minut przed oznaczonym czasem.
Academy47 przekazuje Zamawiającemu potwierdzenie zawarcia Umowy oraz wyrażenia zgody na dostęp do Usługi w okolicznościach powodujących utratę prawa odstąpienia od Umowy na trwałym nośniku (poprzez e-mail).
Płatności za dostęp do Usługi można dokonać w sposób wybrany w momencie rejestracji na Platformie Szkoleniowej lub przy dokonywaniu płatności.
Płatności można dokonać poprzez platformę udostępnioną przez Academy47 – obsługiwane karty płatnicze to Visa, Mastercard, Maestro, Po zakupieniu Usługi Zamawiający otrzymuje na podany adres e-mail potwierdzenie zakupu wraz z fakturą w wersji elektronicznej na co wyraża zgodę. Warunkiem otrzymania faktury na dane firmowe Zamawiającego jest wpisanie odpowiednich danych firmy w formularzu zamówienia przed dokonaniem płatności za Usługę.
W ramach świadczenia Usługi Szkoleniowej udziela on Zamawiającemu niezbywalnej, niewyłącznej i ograniczonej licencji jedynie na odtwarzanie Materiałów szkoleniowych i wyłącznie przez Uczestników Szkolenia. Uczestnik szkolenia zobowiązany jest do powstrzymywania się od kopiowania, modyfikowania, rozpowszechniania, transmitowania, lub wykorzystywania w inny sposób jakichkolwiek Materiałów Szkoleniowych. Zabroniona jest sprzedaż, najem dzierżawa lub jakiekolwiek odpłatne lub nieodpłatne zbycie Materiałów Szkoleniowych. Niedozwolone są jakiekolwiek próby wprowadzania na Platformę Szkoleniową szkodliwych danych (oprogramowanie złośliwe w tym wirusy, pliki szpiegujące, „robaki” itp.).
W ramach świadczenia Usługi Szkoleniowej na życzenie Zamawiającego Academy47 udostępni Uczestnikom Szkolenia do wykonania zadania, testy sprawdzające wiedzę nabytą w związku z uzyskanym dostępem do Materiałów Szkoleniowych. Po prawidłowym wykonaniu zadań czy też pozytywnym wyniku testu Academy47 wystawi certyfikat ukończenia szkolenia.

§ 5
WYMAGANIA TECHNOLOGICZNE I SPRZĘTOWE ORAZ ZWIĄZANE Z DOSTĘPEM DO PRZEGLĄDAREK NIEZBĘDNE DO KORZYSTANIA Z USŁUGI

Do zawarcia Umowy niezbędne jest, aby Zamawiający:
1. posiadał dostęp do Internetu (o parametrach podanych poniżej),
2. korzystał z urządzenia posiadającego przeglądarkę internetową o danych podanych poniżej,
3. posiadał dostęp do skrzynki poczty e-mail.
Do korzystania z Platformy Szkoleniowej niezbędne jest, aby Uczestnik Szkolenia posługiwał się urządzeniem, które spełnia wymagania techniczne określone poniżej:
1. Aplikacja i wszystkie jej funkcje są obsługiwane przy użyciu najnowszych wersji przeglądarek: Chrome (posiada automatyczne aktualizacje, Firefox (posiada automatyczne aktualizacje), Safari;
2. Do korzystania z treści video wymagane są przeglądarki które potrafią dekodować filmy H.264 w odtwarzaczu HTML5;
3. Aplikacja działa na wielu systemach operacyjnych, ale możemy zagwarantować pełną funkcjonalność tylko na platformach, które są nadal wspierane przez ich dostawców;
4. Uczestnicy Szkolenia muszą posiadać dostęp do internetu z minimalną stałą prędkością 500 kbps, aby móc odtwarzać treści w niskiej rozdzielczości. Dla lepszych wrażeń z używania aplikacji zalecamy korzystanie z połączenia internetowego o prędkości 5 Mb/s lub szybszego. Jeśli to możliwe, preferowane są przewodowe połączenia internetowe;
5. Zaleca się powstrzymanie się od korzystania z innych aplikacji podczas odtwarzania Materiałów Szkoleniowych, korzystanie z Platformy Szkoleniowej włączenie obsługi plików cookies w przeglądarce internetowej.
6. Academy47 nie gwarantuje prawidłowego działania Platformy Szkoleniowej w przypadku, gdy Platforma sprzętowa Uczestnika Szkolenia nie spełnia wymogów technicznych określonych w Regulaminie.
Academy47 dokłada wszelkiej staranności w celu zapewnienia wysokiej jakości działania Platformy Szkoleniowej, ale w zakresie wynikającym z właściwości sieci Internet, z której korzysta Uczestnik Szkolenia, Academy47 nie gwarantuje nieprzerwanego i niezakłóconego dostępu do Platformy Szkoleniowej.
Obowiązkiem Zamawiającego, przed rejestracją i zawarciem Umowy, jest sprawdzenie, czy posiadane przez niego Platformy sprzętowe spełniają wymogi techniczne określone w Regulaminie. W razie wątpliwości, Zamawiający ma prawo zwrócić się do Academy47 z wnioskiem o udzielenie dodatkowych wyjaśnień.
Ze względu na niezależne od Academy47 właściwości środowiska informatycznego, którym posługuje się Uczestnik Szkolenia korzystanie z Platformy Szkoleniowej na platformach sprzętowych może być ograniczone lub niemożliwe, a jakość odtwarzanych Materiałów Szkoleniowych obniżona – w przypadku istnienia/aktywności w ramach ww. środowiska oprogramowania pochodzącego od podmiotów trzecich lub od Uczestnika Szkolenia (w szczególności różnego rodzaju firewalli, programów antywirusowych, blokad, w tym uniemożliwiających wyświetlanie reklam), jego kombinacji lub konfiguracji, mających wpływ na udostępnioną funkcjonalność lub prawidłowe działanie techniczne Platformy Szkoleniowej na Platformach sprzętowych. W przypadku zaistnienia takiej sytuacji, może w szczególności okazać się konieczne odinstalowanie określonego oprogramowania ze środowiska informatycznego, którym posługuje się Uczestnik Szkolenia lub dodanie w jego ramach określonego wyjątku.
Funkcjonowanie Platformy Szkoleniowej wymaga czasowego monitoringu technicznego, poprawek i konserwacji, co może spowodować czasowe przerwy w działaniu Platformy Szkoleniowej. W przypadku przerw w możliwości dostępu, trwających dłużej z powodu awarii, Academy47 dołoży starań, aby awaria została usunięta w najkrótszym możliwym czasie.

§ 6
ZAWIESZENIE USŁUG, ZAPRZESTANIE ŚWIADCZENIA USŁUG, ODSTĄPIENIE OD UMOWY

Uczestnik Szkolenia jest zobowiązany do korzystania z udostępnionych Materiałów Szkoleniowych w ramach Usługi Szkoleniowej w sposób zgodny z prawem i dobrymi obyczajami mając na uwadze poszanowanie dóbr osobistych oraz praw autorskich i własności intelektualnej Academy47 oraz osób trzecich. Zamawiający obowiązany jest do wprowadzania danych zgodnych ze stanem faktycznym. Obowiązuje zakaz dostarczania treści o charakterze bezprawnym.
Działania wykraczające poza udzieloną licencję stanowią naruszenie Regulaminu.
Dostęp do Platformy Szkoleniowego lub Materiałów Szkoleniowych może zostać zablokowany w przypadku, gdy Uczestnik Szkolenia:
1. wykorzystuje Platformę Szkoleniową lub Materiały Szkoleniowe do celów niezgodnych z ich przeznaczeniem lub na szkodę Academy47 lub osób trzecich;
2. utrudnia innym korzystanie z Platformy Szkoleniowej w tym przez ingerencję w poszczególne jej elementy lub środowiska informatycznego, w którym znajdują się Materiały Szkoleniowe;
3. podejmuje działania mające na celu odczytanie danych innych Uczestników Szkolenia w tym haseł do kont;udostępnia login lub hasło do swojego konta na Platformie Szkoleniowej innym nieuprawnionym osobom trzecim;
4. podejmuje działania, które mogą zakłócać funkcjonowanie Platformy Szkoleniowej lub środowiska informatycznego;
5. dopuszcza się naruszenia Regulaminu – po skierowaniu do niego przez Academy47 wezwania w tym zakresie oraz bezskutecznym upływie wyznaczonego terminu na zaniechanie.
Anulowania dostępu do Materiałów Szkoleniowych można dokonać w Panelu Zamawiającego klikając przycisk „Anuluj szkolenie” w każdym czasie bez podania przyczyny co powoduje zaprzestanie świadczenia Usługi Szkoleniowej. Jednakże w takim przypadku Academy47 nie ma obowiązku zwrotu uiszczonej płatności.
Zamawiający, będący Konsumentem, który zawarł z Academy47 umowę może, na podstawie art. 27 ustawy z dnia 30 maja 2014 r. o prawach konsumenta – bez podania przyczyny – odstąpić od Umowy w terminie 14 dni od dnia zawarcia Umowy jednakże, przed zawarciem Umowy, której przedmiotem jest świadczenie Usługi Szkoleniowej Zamawiający będący Konsumentem poprzez zaznaczenie odpowiedniego pola w formularzu zamówienia może wyrazić zgodę, aby Academy47 rozpoczął świadczenie Usługi Szkoleniowej przed upływem terminu na odstąpienie od Umowy zgodnie z art. 38 ustawy z dnia 30 maja 2014 r. o prawach konsumenta. W tym przypadku, gdy spełnianie świadczenia polegające na dostępie do Usługi Szkoleniowej rozpoczęło się za wyraźną zgodą Konsumenta przed upływem terminu do odstąpienia od Umowy i po poinformowaniu go o utracie prawa odstąpienia od Umowy Zamawiający będący Konsumentem traci prawo do odstąpienia od Umowy.
Odstąpienie od Umowy następuje po złożeniu przez Zamawiającego stosownego oświadczenia o odstąpieniu dokonanego na piśmie na adres: Academy47 spółka z o.o. , ul. Krucza 50, 00-025 Warszawa lub na adres emailowy: [email protected]
Do zachowania tego terminu wystarczy wysłanie oświadczenia przed jego upływem.
Oświadczenie można złożyć na formularzu, którego wzór stanowi załącznik nr 1 zgodnie z ustawą z dnia 30 maja 2014 r. o prawach konsumenta, dostępnym na stronie https://academy47.com/terms-for-service
W przypadku odstąpienia od Umowy przed rozpoczęciem świadczenia Usług, Umowę uważa się za niezawartą.
Konsument traci prawo odstąpienia od Umowy, Jeżeli Academy47 wykonała w pełni Usługę Mentoringu za wyraźną zgodą Konsumenta i po poinformowaniu go przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez Academy47 Konsument traci prawo odstąpienia od Umowy.
Jeżeli Zleceniodawca będący Konsumentem poprzez zaznaczenie odpowiedniego pola w formularzu zamówienia zażąda,aby Academy47 rozpoczął świadczenie Usługi Mentoringu przed upływem terminu na odstąpienie od Umowy ponosi on koszt świadczeń spełnionych do chwili poinformowania Academy47 o odstąpieniu od Umowy. Kwotę zapłaty oblicza się proporcjonalnie do zakresu spełnionego świadczenia, z uwzględnieniem uzgodnionej ceny.
Zwrotu dokonanej płatności dokonuje przy użyciu takich samych sposobów płatności, jakie zostały użyte przez Zamawiającego będącego Konsumentem w transakcji, chyba że Zamawiający będący Konsumentem wyraził zgodę na inne rozwiązanie. W każdym z przypadków Zamawiający będący Konsumentem nie ponosi żadnych opłat w związku ze zwrotem płatności.

§ 7
OCHRONA PRAW AUTORSKICH

Academy47 udziela Zamawiającemu niewyłącznej, nieograniczonej terytorialnie licencji na korzystanie z Materiałów Szkoleniowych na czas trwania Umowy.
Wszystkie materiały (w tym teksty, grafiki, logotypy) zamieszczone na Platformie Szkoleniowej są własnością Academy lub osób trzecich co do których Academy47 ma prawo korzystania.
Zabronione jest kopiowanie jakichkolwiek materiałów w tym Materiałów Szkoleniowych będących własnością Academy47 lub osób trzecich, w tym ich udostępnianie w jakiejkolwiek formie i miejscu bez pisemnej zgody Academy47.
Zabrania się pobierania jakichkolwiek materiałów z Platformy Szkoleniowej oraz wykorzystywania ich do celów marketingowych oraz handlowych bez pisemnej zgody Academy47.

§ 8
DANE OSOBOWE

Administratorem danych osobowych Zamawiającego jest Academy47. W przypadku, gdy Uczestnikiem Szkolenia będzie inna osoba wskazana przez Zamawiającego to Zamawiający udostępni Academy47 dane osobowe tych Uczestników Szkolenia zgodnie z obowiązującymi przepisami prawa za co ponosi pełną odpowiedzialność. W momencie udostępnienia przez Zamawiającemu danych osobowych Uczestników Szkolenia, administratorem danych osobowych staje się Academy47.
Wszelkie informacje dotyczące przetwarzania danych osobowych w tym informacje o przysługujących prawach osób których dane są przetwarzane znajdują się w Polityce Prywatności dostępnej pod adresem https://perfo.academy47.com/privacypolicy

§ 9
REKLAMACJE

W przypadku, gdy Zamawiający uzna, że Academy47 nie realizuje jakichkolwiek usług zgodnie z przyjętymi zobowiązaniami, może złożyć reklamację. Zamawiający proszony jest o poinformowanie Academy47 o uchybieniach tak, aby umożliwić Academy47 i ustosunkowanie się do nich.
Reklamacje dotyczące działania Platformy Szkoleniowej mogą być zgłaszane przez Zamawiającego na adres siedziby Academy47 lub drogą elektroniczną na adres [email protected]
Zgłoszenie reklamacyjne powinno zawierać imię i nazwisko i nazwę firmy , adres email użyty przy rejestracji i logowania na Platformie Szkoleniowej, opis swoich zastrzeżeń, a także swoje żądanie, podpis Zamawiającego – w przypadku reklamacji złożonej w formie pisemnej.
W przypadku, gdy reklamacja nie zawiera danych umożliwiających kontakt z Zamawiającym, reklamację pozostawia się bez rozpoznania.
Jeżeli reklamacja zawiera inne braki niż wskazane ust. 3 lub jeżeli będzie to konieczne do prawidłowego rozpatrzenia reklamacji, Academy47 poprosi/wezwie Zamawiającego do jej uzupełnienia, określając termin, nie krótszy niż 7 dni, i zakres tego uzupełnienia z pouczeniem, że nieuzupełnienie reklamacji w określonym terminie spowoduje pozostawienie reklamacji bez rozpoznania. Po bezskutecznym upływie wyznaczonego terminu reklamację pozostawia się bez rozpoznania.
Academy47 niezwłocznie potwierdza wpłynięcie reklamacji.
Academy47 udziela odpowiedzi na reklamację w formie pisemnej lub w formie elektronicznej, jeśli w takiej formie złożono reklamację lub Zamawiający wyraził zgodę na odpowiedź w tej formie, w terminie 30 dni od dnia jej złożenia.
W przypadku nierozpatrzenia reklamacji w terminie 30 dni od dnia jej wniesienia, uważa się, że reklamacja została uwzględniona.

§ 10
POSTANOWIENIA KOŃCOWE I ZMIANA REGULAMINU

Postanowienia niniejszego Regulaminu nie mają na celu wyłączać ani ograniczać jakichkolwiek praw Zamawiającego będącego konsumentem w rozumieniu przepisu art. 221 ustawy z dnia 23 kwietnia 1964 r. Kodeks cywilny (t. j.: Dz. U. z 2017 r. poz. 459, ze zm.), przysługujących mu na mocy bezwzględnie obowiązujących przepisów prawa. W przypadku niezgodności postanowień niniejszego Regulaminu z tymi przepisami, pierwszeństwo mają te przepisy.
Academy47 informuje Zamawiającego będącego Konsumentem o możliwości skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. Zasady dostępu do tych procedur dostępne są w siedzibach lub na stronach internetowych podmiotów uprawnionych do pozasądowego rozpatrywania sporów. Mogą nimi być w szczególności rzecznicy praw konsumenta lub Wojewódzkie Inspektoraty Inspekcji Handlowej, których lista jest dostępna na stronie internetowej Urzędu Ochrony Konkurencji i Konsumentów: http://www.uokik.gov.pl/spory_konsumenckie.php
Zamawiający będący Konsumentem może również złożyć swoją skargę za pośrednictwem unijnej platformy internetowej ODR (online dispute resolution), dostępnej pod adresem: http://ec.europa.eu/consumers/odr/.
Zamawiający ma prawo dochodzenia roszczeń w postępowaniu sądowym przed właściwym miejscowo i rzeczowo sądem, bez konieczności korzystania z sądownictwa polubownego.
W przypadku braku możliwości polubownego rozwiązania sporu pomiędzy Academy47 a Zamawiającym niebędącym Konsumentem, sądem właściwym do rozpatrywania sporu jest sąd właściwy dla siedziby Academy47.
Regulamin może podlegać zmianom w przypadku zmiany prawa lub warunków świadczenia Usługi.
Academy47 informuje o zmianie Regulaminu za pośrednictwem strony internetowej oraz przesyłając informację na adres poczty elektronicznej Zamawiającego.
Zmiany w Regulaminie wywołują skutek – w braku odmiennego zastrzeżenia – od dnia zamieszczenia informacji o zmianie. Nowe postanowienia Regulaminu są stosowane do usług zamówionych po dniu wejścia w życie zmian Regulaminu.
W przypadku, gdy Zamawiający będący Konsumentem nie akceptuje zmiany Regulaminu, jest on uprawniony do wypowiedzenia Umowy ze skutkiem natychmiastowym, pod warunkiem złożenia wypowiedzenia, w formie w której zawarto Umowę, nie później niż w terminie 14 dni od poinformowania o zmianie.
Academy47 nie ponosi odpowiedzialności za utrudnienia w korzystaniu z Platformy Szkoleniowej powstałych na skutek okoliczności, którym Academy 47 nie mogło zapobiec lub przewidzieć przy zachowaniu należytej staranności, w tym problemów związanych z działaniem sieci teleinformatycznej lub łączy internetowych, wywołanych zdarzeniami losowymi lub siłą wyższą, za szkody wywołane korzystaniem z Platformy Szkoleniowej w sposób nieprawidłowy, sprzeczny z Regulaminem oraz z tytułu awarii sprzętu, systemu lub oprogramowania będą skutkiem czynników niezależnych od Academy47.
W przypadku umów zawieranych z Zamawiającymi niebędącymi Konsumentami odpowiedzialność Academy47 jest ograniczona do przypadku umyślnego wyrządzenia szkody i do wysokości rzeczywiście poniesionych przez nich strat tzn. wyłącza się odpowiedzialność z tytułu utraconych korzyści.
Osoby naruszające przepisy prawa oraz warunki Regulaminu, ponoszą pełną odpowiedzialność za takie działania.
Załącznikami do niniejszego Regulaminu jest Załącznik nr 1: wzór formularza odstąpienia od umowy.

TERMS AND CONDITIONS FOR PROVIDING E-LEARNING TRAINING SERVICES

These Terms and Conditions (hereinafter referred to as the “T&C”) specify terms of access to training courses within e-learning, terms, conditions, and manner of providing services via the Training Platform available at www.academy47.com. under the link learn.academy47.com

§ 1.
DEFINITIONS

Whenever the mention:

Academy47 – it should be understood as the company ACADEMY47 Spółka z ograniczoną odpowiedzialnością with the registered office in Warsaw at Krucza 50 Street, 00-025 Warsaw, entered into the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register under the KRS number 0000927172 with the share capital of 50 000,00 PLN, holding NIP: 5252880776, REGON: 520213578;

Ordering Party – an entity, including a natural person with full legal capacity, which concludes an agreement with Academy47 ;

Training Participant – a person who has access to the Training Materials as part of the provision of the Training Service and/or uses the access to the Mentoring Service, that is, the Ordering Party or another person indicated by the Ordering Party;

Consumer – a natural person who is a consumer in accordance with Article 221 of the Civil Code using the Training Platform means a natural person who performs a legal action with an entrepreneur that is not directly related to their business or professional activity, or a natural person who concludes an agreement directly related to their business activity, when the content of this agreement indicates that it is not of a professional nature for them, resulting in particular from the subject of their business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity;

Training materials – all training content published and made available on the Training Platform, in any form, including as educational programs, courses, modules, in particular, digital content, audiovisual, text, graphics, photographs, and sound, which are manifestations of creative activity of an individual character recorded in any form, regardless of their purpose and regardless of whether they are work within the meaning of the Act of 4 February 1994 on Copyright and Related Rights, in particular, video recordings of courses, single training courses and on-line educational programs, in particular on marketing, sales and HR topics;

Training Platform – Internet e-learning platform available at the address www.academy47.com under the link learn.academy47.com
or its extensions allowing access to selected Training Materials under the terms and conditions specified in the Agreement. The main purpose of the platform is to provide knowledge on marketing, sales, and HR topics. Access to it is password protected and requires logging in using an identifier called login.

Agreement – an agreement concluded remotely by electronic means (without the physical presence of the parties) via the website www.academy47.com with Academy47 and the Ordering Party, the object of which is the provision by Academy47 of Services offered on the Training Platform, the content of the Agreement constitutes the provisions of the T&C;

Training Service – a paid service consisting of access to digital content, audiovisual and video files in the form of selected Training Materials, allowing a registered and logged-in Training Participant to use them via the Training Platform at a time and place selected by him;

Mentoring Service – a paid service consisting of access to individual or group participation in online classes with a person indicated by Academy47 in order to ask questions, individual coaching, or use of knowledge acquired during the Training Service, available on the Training Platform;

Data of a Training Participant – data with the use of which Academy47 may contact a Training Participant in order to perform the Service, including name and surname, name of the entity, e-mail address, payment data, address, telephone number, data provided in a survey/questionnaire.

Account – an account that is created by the Ordering Party in order to conclude the Agreement and access the Training Platform.

HW Platform – software environment meeting the minimum technical parameters specified in the T&C and having access to the Internet, allowing the use of the Training Platform;

Price List – the current price list for purchasing access to particular Modules placed on the website www.academy47.com or its extensions.

§ 2
GENERAL PROVISION

Academy47 provides Training Services and Mentoring Services, hereinafter collectively referred to as “Services” or separately referred to as a Service, provided that the provisions of these T&C apply to each of these Services, in accordance with the T&C and provisions of law.
The Training Service provided by Academy47 is available 7 days a week, 24 hours a day.
Academy47 reserves the right to amend the Services, in particular, the content of the Training Materials offered to the Ordering Party on the Training Platform and the principles of providing the Services, of which it shall inform the Ordering Party in a manner appropriate for amending the T&C.
The Ordering Party may at any time of their choosing access and download the T&C, save, open, print, or save them.
All information, Training Materials provided to the Ordering Party located on the Training Platform, including, in particular: trademarks, trade names, advertising slogans, logos, graphics, images, drawings, photographs, digital materials, audiovisual recordings, and domain names that appear on the Training Platform belong to or belong to Academy47 and are subject to legal protection.
The contents of the Training Platform, in particular the Training Materials, are protected by law.
Everything placed on the Training Platform, including in particular its trade name, advertising slogans, logos, graphics, or images, may not be copied or reproduced in any way, without the prior written consent of Academy47.
The Ordering party bears responsibility for the infringement of Academy47 rights, in particular copyright and related rights, right to the trademark, personal and property rights of Academy47 and third parties, including responsibility for the Participants of the Training other than the Ordering party;

§ 3
TERMS AND CONDITIONS OF USING SERVICES ON THE TRAINING PLATFORM

As the T&C specify the principles of concluding the Agreement and providing the T&C are available at https://academy47.com/terms-of-service.
The T&C constitute the terms referred to in article 8 of the Act of 18 July 2002 on the provision of services by electronic means.
A participant of the Training may be the Ordering Party or another person indicated by the Ordering Party who wishes to gain or supplement their knowledge in the area of sales, marketing, or HR as part of the access to the Training Platform at www.academy47.com.
Academy47 reserves the right to a verification process for Training Participants prior to granting access to the Services by completing a survey made available to the Ordering Party prior to purchasing the Services.
Before purchasing the Service the Ordering Party should read the T&C. By registering an Account on the Training Platform the Ordering Party confirms that they have read the T&C and accepts the provisions contained therein in full and without reservation. This statement is made by ticking an appropriate box (check box) in the course of registration.
Academy47 uses the mechanism of “cookies” files, which are saved by the server on the end device during the use of the Training Platform and the website www.academy47.com by Ordering Parties. The use of cookies is aimed at the correct functioning of the Training Platform on the end devices of the Training Participants. In order to learn detailed information about the use of cookies, please read the cookie policy located on https://www.academy47/privacypolicy.
The Ordering Party is obliged to protect their password to the Account against unauthorized persons and is not allowed to make the password available to third parties, excluding the Training Participants. Academy47 shall not turn to the Ordering Party or the Participant of the Training with a request to provide him with the password. At the same time, Academy47 applies safeguards to protect the data in the Ordering party’s account against unauthorized access and use.
The Ordering Party and the Training Participant is entitled to use the resources of the Training Platform exclusively for their own use. The use of resources and functions of the Training Platform by the Ordering Party for business or commercial purposes would violate any interest of Academy47, in particular for distribution or marketing of the Training Materials offered by Academy47, their publication, distribution, reproduction, or any commercial use, neither in whole nor in part, in any form and scope, is not permitted without prior, explicit consent of Academy47.
In order to create an Account on the Training Platform, it is necessary for the Ordering Party to have an active and correctly configured e-mail account and to complete Registration.
In order to register, the Ordering Party should complete the registration form made available by Academy47 on the Training Platform and make the completed registration form available to Academy47 via e-mail. During the Registration, the Ordering Party establishes their own login and password.
After submitting the completed registration form, the Ordering Party shall immediately receive, via e-mail to the e-mail address provided in the registration form, an e-mail with a link that needs to be activated in order to confirm Registration or an e-mail with a temporary password to the Account. As soon as the aforementioned link is activated or as soon as the first login is made (depending on which occurs first), the Ordering Party obtains the possibility to access the Account (including the possibility to manage their data). In order to use the Account, it is required to log in using the password. The condition of registration on the Training Platform shall be providing all required data by the Ordering Party.
Academy47 prohibits the provision by Training Participants of content that is prohibited by law, including in particular content that is offensive or vulgar, inciting violence, racial hatred, or other content that is inconsistent with morality, or that violates personal rights and other rights of third parties.
Any action of the Training Participant should be in accordance with the law, the T&C, and good manners, with respect to the personal rights of third parties, especially other Training Participants and should be in accordance with the rules of social coexistence.

§ 4
SERVICES PROVIDED BY ACADEMY47, CONCLUSION OF THE AGREEMENT AND PAYMENTS

Academy47 provides the following free-of-charge services electronically to the Ordering Party who has made the Registration:
1. running an Account,
2. provision of information in the form of a Newsletter available after the purchase of Services.
The Account service is available after the Registration under the terms described in § 3 of the T&C.
The Account service is provided for an indefinite period of time, from the moment of Account registration. The Ordering Party r who has registered can independently, at any time and without giving reasons, remove his Account or submit to Academy47 a request for its removal.
The service of maintaining an Account is free of charge, however, in order to gain access to the full scope of functionality of the Training Platform, including the Training Materials, it is necessary to pay for the Service.
Academy47 shall be entitled to delete the Account or block the Ordering Party’s access to the Services in the event of acting to the detriment of Academy47 or other Training Participants, contravening the provisions of law, including the T&C, in particular in the event that the Ordering Party provided data which is untrue, inaccurate or infringes the rights of third parties during the Registration on the Training Platform or while paying for the Services if the Ordering Party uses the Training Platform in a manner inconsistent with the applicable law.
The Newsletter service consists of Academy47 sending to the Ordering Party’s email address messages containing commercial information and offers concerning services provided by Academy47 and its partners. Ordering Newsletter service takes place through the Ordering Party’s use of appropriate Newsletter activation fields in the registration form or in other forms made available by Academy47.
Resignation from the Newsletter service is possible at any time, without stating a reason – the Ordering Party may resign from receiving the Newsletter by marking an appropriate option to resign from the Newsletter service using a link placed in each Newsletter message.
Within the access to the Training Platform, the Ordering Party may choose and purchase Services available on the Training Platform.
Ordering a Service constitutes an Agreement concluded for a definite period of time for the period indicated in the selection of a given Service. In order to place an order, the Ordering Party must, if it has not already done so, register as a Training Participant, select a Service, and place an order,
The Program of individual Training Services specifying the thematic scope of the Training Materials is available on the Training Platform.
Access to Training Materials within the scope of the purchased access to the Training Services placed on the Training Platform shall be possible throughout the term of the Agreement.
The provision of the Training Service shall take place immediately after Academy47 receives confirmation of payment acceptance from the payment operator, whereby Academy47 shall not be liable for the consequences of delays in payment which are the responsibility of payment operators.
The conclusion of the Agreement between Academy47 and the Ordering Party occurs after the Ordering Party registers on the website www.academy47.com selects the Service and pays for access to the Service.
The realization of the Training Service shall be understood as including access to the purchased Training Materials for a particular Account. The Training Participant after logging in to his Account has access to the purchased Training by the tab “My Courses”.
The purchased Training Service shall be active for the period of time indicated in the description of the Training Service from the date of transferring to the Ordering Party information on crediting the entire due payment, which shall allow the Ordering Party to use the Training Platform during this period.
In the event that the Ordering Party purchases the Mentoring Service specifying the day and time when it is to take place, the Ordering Party shall be granted access to the purchased Mentoring at least 30 minutes before the specified time.
Academy47 shall provide the Ordering Party with a confirmation of concluding the Agreement and agreeing to access the Service in circumstances resulting in losing the right to withdraw from the Agreement on a durable medium (via e-mail).
Payments for access to the Service may be made in a manner selected at the moment of registration on the Training Platform or when making the payment.
Payments can be made by Dotpay, credit card – Visa, Mastercard, or Maestro, After purchasing the Service the Customer receives a confirmation of the purchase and an invoice in the electronic form to which they agree. In order to receive an invoice for the company details of the Ordering Party r, the relevant company details must be entered in the order form before making the payment for the Service.
As part of providing the Training Service, he grants the Ordering Party a non-transferable, non-exclusive, and limited license only to reproduce the Training Materials and only by the Training Participants. The Training Participant shall refrain from copying, modifying, distributing, transmitting, or otherwise using any of the Training Materials. You may not sell, lease, rent or dispose of the Training Materials in any manner, whether for consideration or not. You shall not attempt to upload harmful data (malicious software including viruses, spyware, “worms” etc) to the Training Platform.
Within the scope of providing the Training Service at the request of the Ordering Party Academy47 shall make available to the Training Participants to perform tasks and tests checking the knowledge acquired in connection with the access to the Training Materials. After a correct performance of the tasks or a positive result on the test, Academy47 issues a certificate of completion of the training.

§ 5
TECHNOLOGICAL AND HARDWARE REQUIREMENTS AS WELL AS REQUIREMENTS RELATED TO THE ACCESS TO BROWSERS NECESSARY TO USE THE SERVICE

In order to conclude the Agreement, it is necessary that the Ordering Party:
1. has access to the Internet (with the parameters specified below),
2. uses a device with an Internet browser with the data specified below,
3. have access to an e-mail box.
In order to use the Training Platform it is necessary for the Trainee to use the device and meet the technical requirements specified below:
1. The application and all its features are supported using the latest versions of the following browsers: Chrome (has automatic updates, Firefox (has automatic updates), Safari;
2. Video content requires browsers that can decode H.264 videos in the HTML5 player;
3. The application runs on many operating systems, but we can only guarantee full functionality on platforms that are still supported by their providers;
4. Trainees must have internet access with a minimum sustained speed of 500 kbps to play low-resolution content. For a better application experience, we recommend using an internet connection of 5 Mbps or faster. If possible, wired internet connections are preferred;
5. It is recommended that you refrain from using other applications while playing the Training Materials, use the Training Platform to enable cookies in your web browser.
6. Academy47 does not guarantee the correct operation of the Training Platform in the event that the Training Participant’s Hardware platform does not meet the technical requirements specified in these T&C.

Academy47 makes every effort in order to ensure the high quality of the Training Platform’s functioning, however, to the extent resulting from the characteristics of the Internet network used by the Training Participant, Academy47 does not guarantee unlimited and uninterrupted access to the Training Platform.
It is the duty of the Ordering Party, prior to registration and conclusion of the Agreement, to check whether the Hardware platforms in their possession meet the technical requirements specified in the T&C. In case of doubt, the Ordering Party has the right to request additional clarification from Academy47.
Due to the characteristics of the IT environment used by the Training Participant that is independent of Academy47, the use of the Training Platform on the Hardware platforms may be limited or impossible and the quality of the reproduced Training Materials may be reduced in the event of the existence/activity within the said environment of software originating from third parties or the Training Participant (in particular various types of firewalls, anti-virus software, blockers, including those that prevent the display of advertisements), its combination or configuration, affecting the provided functionality or correct technical operation of the Training Platform on the Hardware Platforms. In the event of such a situation, it may be necessary to uninstall specific software from the IT environment used by the Training Participant or to add a specific exception within it.
The operation of the Training Platform requires temporary technical monitoring, patching, and maintenance, which may result in temporary interruptions in the operation of the Training Platform

SUSPENSION OF SERVICES, DISCONTINUATION OF SERVICES, WITHDRAWAL FROM THE AGREEMENT

The Training Participant shall be obliged to use the Training Materials made available as part of the Training Service in a manner consistent with law and good practice, taking into account respect for personal rights, copyrights, and intellectual property of Academy47 and third parties. The Ordering Party is obliged to enter data consistent with the actual state. The provision of the content of an unlawful nature is prohibited.
Actions going beyond the granted license constitute a violation of the Regulations.
Access to the Training Platform or Training Materials may be blocked if the Training Participant:
1. uses the Training Platform or Training Materials for purposes inconsistent with their intended use or to the detriment of third parties;
2. impedes the use of the Training Platform by others, including by interference with its elements or the IT environment in which the Training Materials are located;
3. takes actions aimed at reading other Training Participants’ data, including passwords to accounts;
4. provides login or password to their account on the Training Platform to other unauthorized third parties;
5. undertakes actions that may disrupt the Training Platform or IT environment; 6) commits a breach of the Training Regulations
6. commits a breach of the Regulations – after Academy47 has addressed a call to him/her in this respect and after the ineffective lapse of the designated time limit for cessation.
Cancellation of access to the Training Materials may be performed in the Orderer’s Panel by clicking the button “Cancel training” at any time without providing any reason, which results in discontinuation of the Training Service. However, in such a case Academy47 is not obliged to return the payment made.
An Ordering Party who is a Consumer who has concluded an Agreement with Academy47 may, pursuant to Article 27 of the Act of 30 May 2014 on Consumer Rights – without giving reasons – withdraw from the Agreement within 14 days from the date of conclusion of the Agreement, however, before concluding the Agreement the object of which is the provision of the Training Service an Ordering Party who is a Consumer by ticking the appropriate box in the order form may express consent that Academy47 commences the provision of the Training Service before the expiry of the deadline for withdrawal from the Agreement pursuant to Article 38 of the Act of 30 May 2014 on Consumer Rights. In this case, if the provision of the Training Service has begun with the express consent of the Consumer before the expiry of the deadline for withdrawal from the Agreement and after informing him about the loss of the right to withdraw from the Agreement, the Orderer who is a Consumer loses the right to withdraw from the Agreement.
Withdrawal from the Agreement shall take place after the Orderer submits an appropriate statement of withdrawal made in writing to the address: Academy47 spółka z o.o. Krucza 50, 00-025 Warszawa or to the email address: [email protected].
In order to meet this deadline, it is sufficient to send the declaration before its expiry.
The statement can be submitted on the form, the template of which is Appendix 1 in accordance with the Act of 30 May 2014 on consumer rights, available at https://academy47.com/terms-of-service
In the case of withdrawal from the Agreement before the start of the provision of Services, the Agreement is considered not concluded.
The Consumer loses the right to withdraw from the Agreement, If Academy47 performs the Mentoring Service in full with the express consent of the Consumer and after informing the Consumer before the performance starts, that after the performance of Academy47 the Consumer loses the right to withdraw from the Agreement.
If the Principal who is the Consumer, by ticking an appropriate box in the order form, requests that Academy47 starts providing the Mentoring Service before the expiry of the deadline for withdrawal from the Agreement, he/she shall bear the cost of services provided until the moment of informing Academy47 about withdrawal from the Agreement. The amount of payment shall be calculated in proportion to the scope of fulfilled performance, taking into account the agreed price.
Reimbursement of the payment made shall be made using the same methods of payment that were used by the Ordering Party being the Consumer in the transaction unless the Ordering Party being the Consumer agreed to a different solution. In either case, the Consumer Purchaser shall not incur any fees in connection with the return of the payment.

§ 7
COPYRIGHT PROTECTION

Academy47 grants the Ordering Party a non-exclusive, territorially unlimited license to use the Training Materials for the duration of the Agreement.
All materials (including text, graphics, and logos) placed on the Training Platform are the property of Academy or third parties that Academy47 has the right to use.
It is forbidden to copy any materials, including the Training Materials being the property of Academy47 or any third parties, including making them available in any form and place without the written consent of Academy47.
It is forbidden to download any materials from the Training Platform and use them for marketing and commercial purposes without the written consent of Academy47.

§ 8
PERSONAL DATA

The Controller of the Ordering Party’s personal data is Academy47. In the event that the Participant of the Training is another person indicated by the Ordering Party, the Ordering Party shall provide Academy47 with personal data of such Participants of the Training in accordance with the binding legal terms, for which it bears full responsibility. At the moment of providing the Ordering Party with the personal data of the Training Participants, Academy47 becomes the administrator of the personal data.
All information concerning the processing of personal data, including information on the rights of persons whose data are processed, shall be included in the Privacy Policy available at perfo.academy47.com/privacypolicy

§ 9
COMPLAINTS

In the event that the Ordering Party considers that Academy47 does not provide any services in accordance with the accepted obligations, they may file a complaint. The Ordering Party is requested to inform Academy47 of the failures so as to enable Academy47 and respond to them.
Complaints concerning the operation of the Training Platform may be submitted by the Ordering Party to the address of Academy47’s registered office or by e-mail to [email protected]
Notification of complaint should contain the name and surname of the company, email address used during registration and logging on the Training Platform, description of its objections, as well as its demand, signature of the Ordering Party – in the case of a complaint submitted in writing.
In the event that the complaint does not contain data enabling contact with the Ordering Party, the complaint shall be left without consideration.
If the complaint contains other defects than those indicated in para. 3, or if it is necessary for the proper complaint handling, Academy47 shall request/request the Ordering Party to complete the complaint, specifying the time limit, no shorter than 7 days, and the scope of such completion, with the instruction that failure to complete the complaint within the specified time limit shall result in leaving the complaint unprocessed. After the ineffective lapse of the set time limit, the complaint shall be left without consideration.
Academy47 immediately confirms the receipt of the complaint.
Academy47 responds to the complaint in writing or in electronic form if the complaint was lodged in such a form, or the Advertiser agreed to respond in this form, within 30 days from the date of its lodging.
In the event of failure to consider a complaint within 30 days from the date of its lodging, it shall be deemed that the complaint has been considered.

§ 10
FINAL PROVISIONS AND AMENDMENT TO THE TERMS

The provisions of the T&C are not intended to exclude or limit any rights of the Ordering Party being a consumer within the meaning of the provision of Article 221 of the Act of 23 April 1964 of the Civil Code (i.e.: Journal of Laws of 2017, item 459, as amended), to which it is entitled under mandatory provisions of law. In case of inconsistency between the provisions of the T&C and those provisions, those provisions shall prevail.
Academy47 shall inform the Ordering Party who is a Consumer about the possibility of using out-of-court procedures for handling complaints and asserting claims. The rules of access to these procedures are available in the seats or on the websites of entities authorized for out-of-court settlement of disputes. They can be in particular consumer ombudsman or Provincial Inspectorates of Trade Inspection, the list of which is available on the website of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php.
The Ordering Party who is Consumer may also submit his/her complaint via the EU online dispute resolution (ODR) platform, available at: http://ec.europa.eu/consumers/odr/.
The Ordering Party shall have the right to pursue claims in court proceedings before a court of competent local and material jurisdiction, without the need for arbitration.
If an amicable resolution of a dispute between Academy47 and the Ordering Party who is not a consumer is not possible, the court competent to handle the dispute shall be the court with jurisdiction over the seat of Academy47.
The T&C may be amended in the event of changes in the law or in the conditions of providing the Service.
Academy47 shall inform about changes to the T&C through the website and by sending information to the email address of the Ordering Party.
Changes in the T&C take effect – unless otherwise stipulated – from the date of posting information about the change. The new provisions of the T&C shall apply to services ordered after the effective date of such amendments to the T&C.
In the event that the Ordering Party, being a Consumer, does not accept changes to the T&C, he/she is entitled to terminate the Agreement with immediate effect, provided that he/she submits a notice of termination in the form in which the Agreement was concluded, no later than within 14 days of being informed about the change.
Academy47 shall not be liable for difficulties in the use of the Training Platform arising as a result of circumstances that Academy47 could not prevent or foresee with due diligence, including problems related to the operation of data communications network or Internet connections, caused by random events or force majeure, for damage caused by the use of the Training Platform in an improper manner, contrary to the T&C and for equipment, system or software failures resulting from factors beyond Academy47’s control.
In the case of agreements concluded with Ordering Parties who are not Consumers, Academy47’s liability is limited to the case of intentional infliction of damage and to the number of actual losses incurred by them, i.e. liability for lost profits is excluded.
Persons infringing the provisions of law and the conditions of the T&C bear full responsibility for such actions.
Attachment No. 1: specimen form of withdrawal from the agreement is an appendix to these T&C.
